PART 1: LIABILITY WAIVER — ASSUMPTION OF RISK, RELEASE OF LIABILITY, INDEMNITY AGREEMENT
IMPORTANT: READ CAREFULLY BEFORE SIGNING — THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS
This Agreement is between you (“Participant,” “Member,” or “I/me”) and Iron Forged Gym, including its owners, directors, officers, employees, agents, and representatives (collectively “Iron Forged Gym” or “Gym”).
SECTION 1: ACKNOWLEDGMENT OF INHERENT RISKS
I recognize that fitness training, bodybuilding, strength training, and all activities at Iron Forged Gym involve inherent risks of serious physical injury, illness, permanent disability, or death. These risks include but are not limited to: Falls, slips, trips from dropped weights, equipment, or facility hazards; Heavy lifting, dropped weights, overexertion causing strains, sprains, fractures, torn muscles/ligaments; Equipment malfunction/failure causing crushing/impact injuries; Cardiovascular events (heart attack, stroke, arrhythmia) from exertion or pre-existing conditions; Contact with other members or guests causing collision injuries; Exposure to bodily fluids, bloodborne pathogens; Exposure to viruses, bacteria, allergens, infectious illnesses from shared surfaces and equipment (including COVID-19); Training environment effects: high heat, humidity, poor ventilation, loud noise; Training during unstaffed hours: delayed emergency response; Use of shared gloves, mats, equipment: fungal/bacterial infections; Failure to report damaged equipment or hazards; Sparring/combat activity despite prohibition: head injury, knockouts, broken bones; All other risks inherent to serious strength training and bodybuilding activities. I fully understand and acknowledge these risks and declare that I am voluntarily participating with full knowledge of the inherent risks.
SECTION 2: ASSUMPTION OF ALL RISKS
I willingly and knowingly agree to assume ALL RISKS associated with participation in any and all activities at Iron Forged Gym. This includes risks known and unknown, anticipated and unanticipated, that could result in physical injury, emotional injury, permanent disability, paralysis, death, or property damage to myself, others, or Gym property. I accept full personal responsibility for my safety and the safety of anyone I bring to the facility.
SECTION 3: WAIVER AND RELEASE OF LIABILITY
In consideration of being allowed to participate in Iron Forged Gym activities, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Iron Forged Gym and all parties listed above from any and all claims, demands, causes of action, damages, or liabilities of any kind — known or unknown — arising out of or related to my participation in gym activities, to the fullest extent permitted by Pennsylvania law. This release covers: (a) Ordinary negligence by Gym, staff, or contractors; (b) Inherent risks of the activity itself. This release does NOT cover: Gross negligence (extreme recklessness; departure from reasonable care); Reckless disregard of safety (conscious disregard of substantial risk); Intentional misconduct.
SECTION 4: SCOPE OF WAIVER AND RELEASE
This waiver and release includes all injuries, illness, or damage which may occur as a result of: (a) My use of all amenities, equipment, weights, machines, and facilities and my participation in any activity, training, class, program, personal training, instruction, or coaching; (b) The sudden, unforeseen, or unexpected malfunctioning, failure, or defect of any equipment or facility; (c) Iron Forged Gym's instruction, training, supervision, fitness recommendations, or dietary advice; (d) Contact, collision, or interaction with other members, guests, or participants; (e) My failure to report damaged equipment, safety hazards, or unsafe conditions; (f) My violation of Gym rules, including unsafe lifting, reckless dropping of weights, sparring, fighting, unauthorized guest entry, or other prohibited conduct; (g) My training or presence at the Gym during unstaffed hours; (h) Shared use of gloves, mats, equipment creating risk of infection or contamination; (i) Environmental exposure (heat, humidity, air quality, noise, lighting); (j) My failure to disclose medical conditions, medications, or injuries to Gym staff prior to participation.
SECTION 5: RESPONSIBILITY FOR GUESTS AND MINORS
Every guest, visitor, or minor I bring into Iron Forged Gym must: (1) Check in at the front desk; (2) Pay the required day-pass fee ($10); (3) Sign a separate, identical Liability Waiver before using any equipment or area of the Gym. I am fully and personally responsible for the conduct, behavior, and safety of any guest or minor I bring, including any injuries they sustain or damage they cause. I agree to defend, indemnify, and hold harmless Iron Forged Gym and all its personnel from any and all claims arising from the acts, omissions, injuries, or property damage caused by any guest or minor I bring. If any guest violates Gym rules, fails to pay, causes injury, or damages property, my membership may be suspended or permanently terminated at the Gym's sole discretion, with no refund.
SECTION 6: EQUIPMENT DAMAGE AND REPORTING
If any equipment appears damaged, unstable, malfunctioning, or unsafe, I will immediately stop using it and notify the owner or staff by phone (724-550-4595), text (724-277-6834), or in-person. If equipment breaks while I am using it, I agree to report it promptly; failure to report damage may result in me being held financially responsible for repair or replacement costs. I will not attempt to repair, alter, or modify any equipment without prior permission from Gym staff.
SECTION 7: 24-HOUR ACCESS, SECURITY, AND NO-TAILGATING RULES
24-hour access is a privilege for current Iron Forged Gym members only. I must NOT share my key, card, access code, or fob with anyone. I must see and confirm that every person entering behind me scans in with their own valid member card or access code. Allowing any non-member to enter without scanning their own card is called “tailgating” and is strictly prohibited. One (1) confirmed tailgating incident may result in suspension or warning. Two (2) or more confirmed tailgating incidents will result in PERMANENT MEMBERSHIP REVOCATION with NO REFUND. Each unauthorized person admitted may be charged a day-pass fee ($10) in addition to disciplinary action.
SECTION 8: BOXING AREA — ABSOLUTELY NO SPARRING OR CONTACT
ABSOLUTELY NO SPARRING, FIGHTING, WRESTLING, GRAPPLING, OR ANY COMBAT SPORTS ACTIVITY OF ANY KIND IS PERMITTED ANYWHERE IN THE GYM, including boxing sparring, MMA, kickboxing, Muay Thai, wrestling, grappling, BJJ rolling, or “play fighting.” Heavy bags, speed bags, and striking equipment are for individual training and solo conditioning only. Members must use proper hand wraps and/or boxing gloves when striking bags. Gym-provided gloves must be cleaned with disinfectant BEFORE AND AFTER each use. Bag gloves are for hitting the heavy bag ONLY — NOT for hitting people under any circumstances. Any member or guest who engages in sparring or contact activity will be subject to IMMEDIATE SUSPENSION OR PERMANENT BAN, NO REFUND, and possible civil legal action and/or police involvement.
SECTION 9: HEALTH, MEDICAL DISCLAIMER, AND COVID-19 ACKNOWLEDGMENT
I certify that I am in good physical and mental health and am not aware of any medical condition that would make my use of the Gym unsafe. I have not been advised by a physician to restrict exercise. Any coaching, training advice, or fitness recommendations provided by Iron Forged Gym staff are general fitness and bodybuilding guidance only and are NOT medical advice. I understand that Gym staff are NOT doctors, nurses, or medical professionals. I am responsible for consulting my own physician regarding any health concerns, pre-existing conditions, medications, injuries, or exercise restrictions before participating. I acknowledge exposure risk to viruses, bacteria, and infectious diseases (including COVID-19) in shared fitness environments and assume this risk voluntarily.
SECTION 10: BINDING ARBITRATION AND CLASS ACTION WAIVER
Any dispute, claim, or controversy arising from or relating to this Agreement, my membership, or my use of Iron Forged Gym shall be resolved EXCLUSIVELY THROUGH BINDING ARBITRATION, not through court litigation. Arbitration will be administered by AAA (American Arbitration Association) under its Commercial Arbitration Rules. Venue: Fayette County, Pennsylvania. Each party will bear their own attorneys' fees and costs unless AAA rules require otherwise. I WAIVE MY RIGHT TO A JURY TRIAL. I WAIVE MY RIGHT TO PURSUE CLASS ACTION OR GROUP LITIGATION against Iron Forged Gym. Arbitration shall be final and binding and may be enforced in court. This arbitration clause survives termination of my membership.
SECTION 11: PHOTO/VIDEO RELEASE AND PUBLICITY WAIVER (OPTIONAL)
If you consent: I grant Iron Forged Gym an irrevocable, royalty-free, worldwide license to photograph, video record, and audio record me at the Gym and to use these images/videos/recordings for promotional purposes including social media, website, advertising, promotional videos and testimonials. I waive any right of publicity, privacy, or moral rights claims under Pennsylvania law and other laws. This license is irrevocable and no compensation is due to me for use of my image/likeness.
SECTION 12: FORCE MAJEURE — CLOSURES AND BILLING
Iron Forged Gym may pause billing (without refund) and suspend access for closures or service interruptions due to: Acts of God (natural disasters, floods, severe weather, fires); Government orders, mandates, or emergency declarations; Pandemics or epidemics including COVID-19 or future outbreaks; Emergency maintenance and repair; Utilities failure; Any other event beyond Gym's reasonable control. During such closures, billing may be paused and memberships may be extended by the closure duration. No refunds will be issued for paused billing periods. Members retain membership upon reopening.
SECTION 13: SEVERABILITY AND ENTIRE AGREEMENT
If any provision of this Agreement is found invalid, illegal, or unenforceable, that provision is severed, but all other provisions remain in full force and effect. This Agreement constitutes the complete, entire agreement between me and Iron Forged Gym regarding liability, assumption of risk, and Gym use. No oral agreements, representations, or promises modify this written Agreement. Any amendment must be in writing and signed by both parties.
SECTION 14: ACKNOWLEDGMENT OF UNDERSTANDING
I affirm and declare that: I am of legal age (18 years or older), OR I have obtained parental/guardian consent if under 18; I am in good physical and mental health and have no medical condition that would make Gym use unsafe; I have READ THIS ENTIRE AGREEMENT CAREFULLY word-for-word; I fully UNDERSTAND all terms, including what rights I am waiving; I understand that by signing this, I am giving up significant legal rights and remedies that might otherwise be available to me; I understand this is a legally binding contract that will affect my right to sue; I am signing this freely and voluntarily, without coercion, duress, or undue influence; I agree to all terms unconditionally.
PART 2: MEMBERSHIP REGISTRATION & RULES ACKNOWLEDGMENT (PENNSYLVANIA)
SECTION 1: ELIGIBILITY AND MINORS
Membership is available to individuals 16 years of age or older. Minors under 18: A parent or legal guardian must sign all required forms. Minors under 18 must be directly supervised by an adult member or an Iron Forged Gym-approved trainer at all times during gym use. Children under 14: NOT permitted in training areas except when working directly with an Iron Forged Gym-approved trainer. All minors must have a parent/legal guardian who is a current member present in the facility, UNLESS training with an approved trainer.
SECTION 2: USE OF FACILITIES — BODYBUILDING ENVIRONMENT
This is a serious, advanced bodybuilding and strength-training facility. Heavy weights, chalk, loud training noise, and advanced Olympic lifting are common and expected. It is NOT a casual fitness gym with personal training supervision for all members. Members must use spotters and safety equipment (collars, lifting belts, knee wraps, etc.) where appropriate. Members are responsible for selecting exercise loads and exercises that are safe for their individual strength and experience level. Dropping weights intentionally in a reckless manner, throwing equipment, or performing stunt-type behavior is strictly prohibited. Training form and safety are each member's responsibility, not the Gym's.
SECTION 3: EQUIPMENT USE, DAMAGE, AND REPORTING
Members must use all equipment as intended and follow all posted instruction placards and safety signs. If any equipment appears damaged, unstable, malfunctioning, or unsafe, the member must immediately stop using it and notify staff by calling 724-550-4595 or texting 724-277-6834. If equipment breaks while a member is using it, the member must report it promptly; failure to report may result in the member being held financially responsible for repair or replacement costs. Members must not attempt to repair, adjust, modify, or disassemble any equipment without prior written permission from Gym ownership. Report ALL damage, no matter how minor, immediately.
SECTION 4: PERSONAL CONDUCT, ATTIRE, AND HYGIENE
Members must maintain good order, respectful conduct, and consideration for others at all times. Abusive language, harassment, intimidation, bullying, or threatening behavior toward staff or other members is strictly prohibited and grounds for immediate termination. Harassment or discrimination based on race, gender, age, religion, sexual orientation, or disability will not be tolerated. Shirts and appropriate training attire are required while using equipment and walking around the gym at all times. Shirtless training is permitted ONLY in designated posing areas if rules posted in those areas allow it. Members must wipe down equipment with provided disinfectant after each use. Members must re-rack weights and return equipment to proper storage locations. Members must keep walkways, workout areas, and common spaces clear of dumbbells, plates, personal items, and clutter. No food in training areas; beverages allowed only in sealed or lidded containers. Good personal hygiene is required; members with visible signs of skin infections should not use shared equipment.
SECTION 5: GUESTS AND DAY PASSES
Day Pass Rates: Day Pass: $10 per visit; 3-Day Pass: $25; Weekly Pass (7 consecutive days): $30. Every guest must check in at the front desk, pay the required day-pass fee before using any equipment, and sign a separate Liability Waiver form before entering training areas. Guests who do not pay or do not sign a waiver will not be allowed to train. Access to the gym outside of staffed hours is permitted only with prior authorization from the owner or staff. Members are fully responsible for the conduct, behavior, and safety of any guest they bring. If a guest violates Gym rules, fails to pay, causes injury, or damages property, the member's membership may be suspended or permanently terminated at the Gym's sole discretion, with no refund. If you purchase a 3-Day Pass or Weekly Pass and join as a member within 30 days, the amount paid for that pass may be credited toward your first membership term.
SECTION 6: 24-HOUR ACCESS, SECURITY, AND NO-TAILGATING
24-hour access is a privilege for current, active members only. Gym staff may not be present at all times; certain hours are unstaffed. Members training during unstaffed hours do so entirely at their own risk, with no staff supervision or emergency response assistance available. Video surveillance is in effect 24/7 for security and rule enforcement. Staffed hours: Monday–Friday 5am–4pm; Saturday–Sunday 5am–10am. Members must NOT share their key card, key fob, or access code with anyone. Members must NOT allow any person to enter the Gym using their card/code or by following them in. Members must see and confirm that every person entering the Gym behind them is a current member who scans their own valid card/code. Tailgating consequences: First confirmed incident: suspension or warning; Second or subsequent confirmed incidents: PERMANENT MEMBERSHIP REVOCATION with NO REFUND. Each unauthorized person admitted may be charged a $10 day-pass fee in addition to disciplinary action. Video cameras monitor entrances, exits, and key areas 24/7. Members consent to video surveillance by signing this form.
SECTION 7: BOXING AREA — ABSOLUTELY NO SPARRING OR CONTACT
ABSOLUTELY NO SPARRING, FIGHTING, WRESTLING, GRAPPLING, OR COMBAT SPORTS OF ANY KIND ARE PERMITTED ANYWHERE IN THE GYM OR BOXING AREA, including boxing sparring, light/play fighting, MMA, kickboxing, Muay Thai, wrestling, grappling, BJJ rolling, or any drills involving strikes, kicks, punches, or physical contact with another person. Heavy Bag, Speed Bag, and Striking Equipment: For individual training and solo conditioning only. Members must use proper hand wraps AND/OR boxing gloves when striking bags. Gym-provided gloves must be cleaned with the provided disinfectant BEFORE AND AFTER each use. Bag gloves are for hitting the heavy bag ONLY — NOT for hitting people under any circumstances. Wrestling Mats: For solo warm-ups and mobility work only. NOT for lying on, rolling around on, or wrestling with other people. Members must clean the mats with provided disinfectant BEFORE AND AFTER use. Do not use mats if you have visible skin infections or open wounds. Sparring Violation Consequences: Any member or guest who engages in sparring, fighting, wrestling, grappling, or any contact activity will be subject to IMMEDIATE SUSPENSION OR PERMANENT BAN, NO REFUND of membership fees, possible civil legal action by the Gym, and possible police involvement.
SECTION 8: PROPERTY, LOCKERS, AND VALUABLES
Members are fully responsible for their own personal property. Iron Forged Gym is NOT responsible for loss, theft, damage, or disappearance of personal items, valuables, money, phones, keys, vehicles, or other belongings left anywhere on the Gym premises, including lockers, benches, or parking areas. The Gym strongly recommends not bringing valuables; keep personal items with you at all times. Lockers are for day-use only unless otherwise posted. The Gym reserves the right to open, inspect, and clear any locker left occupied overnight; locks will be removed and items disposed of. The Gym assumes no liability for items lost, stolen, or damaged in lockers.
SECTION 9: FOOD, DRINKS, AND SUBSTANCES
No food is allowed in training areas; food may be consumed in designated break areas only. Beverages allowed only in sealed or lidded containers to prevent spills on equipment. Smoking, vaping, e-cigarettes, and tobacco products are strictly prohibited in the entire building and on all premises. Illegal drugs are strictly prohibited; any evidence of drug use results in immediate termination and possible police involvement. Alcohol is strictly prohibited in the building and on premises. Training while impaired by alcohol, illegal substances, or misused prescription/OTC drugs is strictly prohibited. Members appearing impaired may be refused access and asked to leave.
SECTION 10: CLASSES, TRAINERS, AND ADVICE
Any coaching, instruction, or training provided by Iron Forged Gym staff or independent trainers is for general fitness and bodybuilding guidance only and is NOT medical advice or treatment. Gym staff are NOT doctors, nurses, or medical professionals. Members are responsible for consulting their own physician regarding any health concerns, pre-existing conditions, medications, injuries, or exercise restrictions before participating. Only Iron Forged Gym-approved trainers may train clients for compensation (fees) on the Gym premises. Unauthorized trainers are not permitted to coach members on the Gym premises.
SECTION 11: RULE ENFORCEMENT AND TERMINATION
Iron Forged Gym may, in its sole discretion, issue verbal warnings, written warnings, temporarily suspend, or permanently terminate membership or facility access for violations of these rules, non-payment of fees, unsafe behavior, disruptive conduct, or any conduct deemed detrimental to the Gym environment. No refund will be issued upon suspension or termination, whether with or without warning. Serious violations (including fighting, sparring, unauthorized guest entry, tailgating, intentional damage, harassment, threats, or illegal activity) may result in IMMEDIATE TERMINATION without warning or refund. Terminated members may also face civil legal action and possible police involvement. Gym management retains sole discretion in all disciplinary decisions.
SECTION 12: CANCELLATION POLICY
Month-to-Month Memberships: May be cancelled anytime. Cancel by phone (724-550-4595), text (724-277-6834), in-person at front desk, or written notice. Effective at the end of the current billing period. NO REFUNDS once payment is received.
Prepaid Memberships (3-Month, 6-Month, 12-Month): May be cancelled, but early cancellation forfeits the prepaid discount. Remaining prepaid balance will not be refunded. Cancellation effective immediately upon written notice. NO REFUNDS under any circumstances.
Refund Policy: Refunds are NOT offered once payment is received. No refunds for days missed or unused. No refunds for temporary closures, force majeure, or other interruptions. Cancellations must be in writing (email, letter, or in-person acknowledgment with staff signature).
SECTION 13: DISCOUNTED AND PROMOTIONAL MEMBERSHIPS
From time to time, Iron Forged Gym may offer a one-time discounted or promotional membership rate (below standard rates). If you enroll at a discounted or promotional rate, you may keep that rate going forward as long as your membership remains active and never lapses. Your membership must remain active with NO MISSED PAYMENTS, CANCELLATIONS, or INTERRUPTIONS to maintain the discounted rate. If your membership lapses, is cancelled, expires, becomes inactive, or you miss a payment, your discounted or promotional rate is PERMANENTLY FORFEITED. You may rejoin only at the then-current standard rates; the discounted rate cannot be reinstated.
